MyCalling Privacy Statement

1. Introduction

   Merchants Group Holdings and its affiliates (collectively “Merchants” “us” and “we”) understand the importance of protecting your personal data. By using the MyCalling Site, you consent to the data and privacy practices described in this policy as well as the general Terms and Conditions. If you do not agree with the terms of this Privacy Policy, please do not access the Site.

   This Privacy Statement describes how MyCalling collects and uses your personal data, who we share it with, and your choices and rights in relation to your personal data.

   It applies to personal data that we collect from you during your interactions with us, whether online, including through our websites (including mobile sites) and social media sites (“Sites”), mobile applications (“Apps”) (collectively “Online Services”) that link to this Privacy Statement, in writing or orally, or personal data that we may collect offline or receive from third parties.

2. Personal data we collect

   Personal data is any information that identifies you as an individual or relates to you as an identifiable individual.

   Users which transmit confidential, personal, private, personally identifiable, or sensitive data in any other way on MyCalling do so at their sole risk and MyCalling will not be liable in any way.

   We collect information about you when you fill in a sign up form, contact form, chat with us or email us directly. We also collect information when you voluntarily give us when using our services, such as applying to jobs, distributing your resume.

   We may collect information about you in a variety of ways. The information we may collect on the Site includes:

   Personal Data

   Personally, identifiable information, such as your name, address, email address, and telephone number, and demographic information, such as your age, hometown, education, job title, salary, work history and interests, that you voluntarily give to us when you register with the Site or when you choose to participate in various activities related to the Site. You are under no obligation to provide us with personal data of any kind, however your refusal to do so may limit your use of the Site.

   MyCalling allows for the creation of accounts and profiles, information on your profile may be used to identify you personally by anyone using the site. Users expressly agree that the information they upload to MyCalling is not sensitive in nature and is true and accurate.

   Data from your resume

   Information contained in your resume when you apply to a job or distribute your resume.

   This will include any sensitive information that may be contained in your resume. You should exclude or remove any sensitive information from your resume, if you do not wish to disclose this type of information to MyCalling or have it processed by MyCalling.

   Data from Social Networks

   Your Personal Data from social networking sites, such as Facebook, Google+, Twitter, LinkedIn, including your name, your social network username, birth date, email address, profile picture, and public data for contacts, if you connect your account to such social networks.

   We may also collect other information that does not personally identify you. Such other information includes browser and device information, website and application usage data, IP addresses, demographic information such as marketing preferences, geographic location, primary language, and information collected through cookies and other technologies or information that has been anonymised or aggregated. If we link this information with your personal data, we will treat that linked information as personal data.

3. Sensitive personal data

   We collect sensitive personal data relating to your health, and ethnicity. Please note that the disclosure of sensitive or private information is voluntary unless specifically requested.

   Take care not to submit any sensitive or private information to other members or users of the Site and do not submit any sensitive or private information in your public profile.

4. Legal basis for processing your personal data

   When we process your personal data in connection with the purposes set out in this Privacy Statement, we may rely on one or more of the following legal bases, depending on the purpose for which the processing activity is undertaken and the nature of our relationship with you:

   • our legitimate interests (or those of a third party with whom we share your personal data) for the purpose of managing, operating or promoting our business, and intra-Merchants group transfers of personal data for business and administrative purposes, except where such interests are overridden by your interests or fundamental rights or freedoms which require protection of personal data.
   • where this is necessary to comply with a legal obligation on us.
   • where you have consented.

5. Use of your personal data

   MyCalling collects and uses your personal data to operate its website(s) and deliver the services you have requested.

   MyCalling may also share data with the hosting company, Employers and Jobseekers to help deliver career related services, perform statistical analysis, send you email or SMS. In addition, since MyCalling offers career services, MyCalling may share your personal data, which includes but is not limited to your resume and other personally identifiable information, with Employers or with an intermediate third-party.

   MyCalling utilizes an AIMS (Automated Interview Marketing Solution) module. This module gathers additional information on the Jobseeker and Employers, such as Jobseeker’s with no work experience. This is to enable visibility and transparency to Employers on the MyCalling platform.

   The AIMS (Automated Interview Marketing Solution) module is a process that consists of +-75 interview Questions completed by the Jobseeker and Employers and the responses are digitally captured onto the MyCalling Site. The results of the AIMS module are called a ‘Baseline’ and enables the Employers to order Jobseekers that best align with their BU specific baselines results.

   Employers may choose to utilize the Baseline as part of their Candidate filtering process. Traditional recruitment filters will still be applied before/after or without baseline data. No candidates are therefore excluded, only ordered differently.

   MyCalling may keep track of the websites and pages our users visit within MyCalling, to determine what MyCalling services are the most popular. This data is used to deliver customized content within MyCalling to customers whose behavior indicates that they are interested in a subject area.

   MyCalling may disclose your personal data, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on MyCalling or the site; (b) protect and defend the rights or property of MyCalling; and, (c) act under exigent circumstances to protect the personal safety of users of MyCalling, or the public.

   By sharing your contact information with MyCalling, you agree to the MyCalling privacy policy and understand that you may be called or messaged by MyCalling about employment opportunities, job search assistance, career advancement and educational opportunities at the phone number you provided.

   Having accurate information about you permits us to provide you with a smooth, efficient, and customized experience. Specifically, we may use information collected about you via the Site to:

   • Create and manage your account.
   • Respond to queries or requests submitted by you.
   • Email and sms you regarding your account.
   • Enable user-to-user communications.
   • Generate a personal profile about you to make future visits to the Site more personalized.
   • Increase the efficiency and operation of the Site.
   • Monitor and analyze usage and trends to improve your experience with the Site.
   • Notify you of updates to the Site.
   • Offer new products, services, and/or recommendations to you.
   • Perform other business activities as needed.
   • Request feedback and contact you about your use of the Site.
   • Resolve disputes and troubleshoot problems.
   • Respond to product and customer service requests.

   MyCalling use of the data you provide us to match you with jobs that may interest you. We show you these jobs on our website, and send them to you via email, you may opt out of this service.

   MyCalling also matches you with other members on our site, who can review and download your personal data and resume/cv, you may not opt out of this service.

   MyCalling uses cookies to track your visit. Cookies may contain your email address, your IP address and other personal data. you may not opt out of this service.

   MyCalling stores all personal data that you provided us at sign up, and when you edit your profile.

   MyCalling tracks your location (town, city, province) via your IP address, and uses this information to target relevant jobs and members for you when you visit our website. you may opt out of this service.

   When you join social media, groups operated by MyCalling, we collect any personal or survey data that you give us and may share such information with our partners. You may be contacted by these partners via phone, email or sms, you may opt out of this service.

   When you join social media, groups operated by MyCalling, we sometimes create an account for you at MyCalling.

   You may update your profile data and resumes/CVs on our website, and can request to have your account deleted and all your data wiped out at any time.

   As a member of MyCalling, we send you emails and sms daily/weekly: for job matches and job application notifications.

   Jobseekers

   MyCalling may submit your application to jobs listed on our website when there is a match. As a member of the Site, you may opt out of this service.

   MyCalling stores any resumes/CVs, and all the information contained therein, that you upload on our website.

   MyCalling tracks which jobs you apply to on our website, and we use this information to better match you with other jobs or members that you may be interested in.

   You may be called or messaged by MyCalling about employment opportunities and job search assistance at the phone number and email address you provide us. You may opt out of this service.

   Employers

   MyCalling uses the data you provide us to match you with Jobseekers and Employers for your job listings. We show your jobs on our website, and send them to our subscriber Employers and Jobseekers when there is a match. As a member of the Site, you may not opt out of this service.

   MyCalling syndicates your job postings on our partner sites. As a member of the Site, you may not opt out of this service.

   MyCalling stores all personal data of the Jobseekers we send you. This includes the candidate resumes/CVs, Bio Video and any information contained therein.

   MyCalling tracks which Jobseekers you like for the jobs you list on our website, and we use this information to better match you with other Jobseekers that you may be interested in. As a member of the Site, you may not opt out of this service.

   You may be called or messaged by MyCalling about Jobseekers matches at the phone number you provide us. You may opt out of this service.

6. Sharing your personal data

   We may share your personal data for the purposes set out in this Privacy Statement (as applicable):

   • with our affiliates and subsidiaries for the purposes set out in this Privacy Statement. Merchants Holding Group is the party responsible for the management of jointly used personal data.
   • with business partners with whom we offer co-branded services or engage in joint marketing activities.
   • with third parties that perform services for us or on our behalf, including email/sms delivery, hosting services, customer service, marketing, data analytics and auditing assistance.
   • where you consent to the sharing of your personal data.
   • if you interact with other users of the Site, those users may see your name, profile photo, personal data and descriptions of your activity.
   • when you post comments, contributions or other content to the Site, your posts may be viewed by Site users.
   • in connection with, any joint venture, merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or to another company.
   • for other legal reasons:
     • we may share your personal data in response to a request for information by a competent authority in accordance with, or required by any applicable law, regulation or legal process;
     • where necessary to comply with judicial proceedings, court orders or government orders;
       or
     • to protect the rights, property or safety of Merchants, its business partners, you, or others, or as otherwise required by applicable law.
   • Any third parties with whom we share personal data are contractually required to implement appropriate data protection and security measures to protect personal data and are not permitted to use personal data for any purpose other than the purpose for which they are provided with or given access to personal data.

   Initially, MyCalling will act as the Responsible Party when handling the Jobseekers Personal Data, and will be responsible for the data processing on its platform. Jobseekers who search the platform provide MyCalling with “consent” as is required by the POPIA and other applicable Data Protection Laws, to allow the Employers to contact them for the specific job listing or to access their CV from the platform. When the Employer contacts the Candidate to help them apply for a job or download their CV from the platform, the Employer becomes the Responsible Party.

   The Employer as the Responsible Party is then required to comply with obligations set out in POPIA and other applicable Data Protection Laws. The Employer must provide certain information to the Candidate and, if they would like to use Candidate’s Personal Data for any other purpose than filling a specific vacancy, the Employer must obtain their own consent from the Candidate, to continue to use the Jobseekers' Personal Data.

   We are not responsible for the actions of third parties with whom you share personal data outside of the MyCalling Site, and we have no authority to manage or control third-party solicitations. If you no longer wish to receive correspondence, emails or other communications from third parties, you are responsible for contacting the third party directly.

7. Choice/Opt Out

   Users who no longer wish to allow their CV to be searchable by our subscribers may opt out of this facility by going to the My account portion on the dashboard, and select ‘non-searchable’.

8. Security of your personal data

   MyCalling is committed to protecting your personal data from accidental or unlawful destruction, loss, alteration, unauthorised access or disclosure by using a combination of physical, administrative and technical safeguards and contractually requiring that third parties to whom we disclose your personal data do the same.

   While we have taken reasonable steps to secure the personal data you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, we cannot guarantee complete security if you provide personal data.

9. Cross border transfers

   MyCalling may transfer your personal data to countries where we do business or to international organisations in connection with the purposes identified above and in accordance with this Privacy Statement.

   Where we transfer your personal data to a country or international organisation that does not provide an adequate level of protection for personal data, we use and adhere to the standard contractual clauses (“to legitimately transfer personal data. You may obtain a copy of these measures by contacting us in accordance with the “How to contact us” section below.

10. Your rights under data protection laws

    MyCalling adheres to applicable data protection laws, which provide you with certain rights relating to your personal data, subject to any legal exceptions. Your rights include:

    • the right to access personal data that we hold about you.
    • the right to rectify inaccurate personal data we hold about you without undue delay, and taking into account the purposes of the processing, to have incomplete personal data about you completed.
    • the right to restrict the processing of your personal data in certain circumstances.
    • the right to receive your personal data from us in a structured, commonly used and machine readable format.
    • where we process, personal data based on your consent, you have the right to withdraw your consent at any time for future processing.
    • where we process, your personal data based upon our legitimate interests or those of a third party, you have the right to object to the processing of your personal data at any time (including to any profiling).
    • where we process your personal data for direct marketing purposes, you have the right to object to processing of your personal data at any time, including profiling to the extent that it is related to such direct marketing.
    • the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.

    You may lodge a complaint with the Information Regulator, if you believe that your data protection rights relating to your personal data have been breached by MyCalling or that your personal data has been compromised in some way.

    Similarly, individuals in the EEA and Switzerland may exercise their rights under any applicable data protection laws by contacting us in accordance with the “How to contact us” section, below.

11. Cookies

    When you access our Online Services, we use cookies (small text files containing a unique ID number which are placed on your PC or device) and similar technologies including scripts, embedded web links, web beacons, Local Shared Objects (flash cookies) and Local Storage (HTML 5). We use cookies to assist us with activities such as:

    • enabling you to sign in to our Online Services;
    • authenticating you;
    • keeping track of information, you have provided to us;
    • improving your browsing experience;
    • customizing our interactions with you;
    • storing and managing your preferences and settings;
    • compiling statistical data;
    • analysing the performance and usability of our Online Services;
    • measuring traffic patterns for our Online Services; and
    • determining which areas of our Online Services have been visited.

    These technologies collect information that your browser sends to our Online Services including your browser type, information about your IP address (a unique identifier assigned to your computer or device which allows your PC or device to communicate over the Internet), together with the date, time and duration of your visit, the pages you view and the links you click.

    Where MyCalling website contains links to third party websites and applications. We are not responsible for and make no representations or warranties in relation to the privacy practices or content of any third party websites and applications. Your use of such sites and applications is subject to the applicable third party privacy statement and is at your own risk.

    Before visiting and providing any information to any third-party websites, you should inform yourself of the privacy policies and practices (if any) of the third party responsible for that website, and should take those steps necessary to, in your discretion, protect the privacy of your information.

13. Retaining your personal data

    We will retain your personal data for as long as is necessary to fulfil the purpose for which it was collected unless a longer retention period is required to comply with legal obligations, resolve disputes, protect our assets, or enforce agreements. The criteria we use to determine retention periods include whether:

    • personal data is needed to maintain accurate business and financial records;
    • you have consented to us retaining your personal data for a longer retention period, in which case, we will retain personal data in line with your consent.

14. Account closure and data deletion

    You may request that we remove your account and delete your personal data.

    In this case, the following conditions will apply:

    • Any active products, services or active job applications and accounts will be canceled.
    • You will no longer be able to log into your account after it is closed.
    • Upon closing your account, your personal data will be permanently deleted. After deletion, your account will be unrecoverable and inaccessible.

15. Updates to this Privacy Statement

    We may update this Privacy Statement at any time. If we do, we will update the “last modified” section at the bottom of this Privacy Statement.

    We encourage you to regularly review this Privacy Statement to stay informed about our privacy practices.
